Margaret from Bournemouth

Margaret called me about selling her house quickly, and was very distressed, as her flat was due to be repossessed at noon the next day. She had an Eviction Order issued by Bournemouth County Court, and had no idea what to do.

First, I went round to Margaret's flat to have a chat and understand the background to her dilemma. Margaret had a large amount of Mortgage Arrears, and she showed me the Notice of Eviction (referred to by the courts as a N54 Notice of Eviction). This gave her Claim number and Warrant number that we would need later. Luckily for Margaret, her flat was worth more than she owed her mortgage lender, so I explained that she should be able to pay off her mortgage lender if she had time to sell her flat. We agreed a price, and set off to stop Margaret being evicted.

The next job was to take Margaret to the County Court and request a hearing to suspend the eviction. We did this by completing an N244 Application Form, and paying the application fee of £35 to the County Court. The hearing was booked for 10:00 the next morning.

I then called my Mortgage Broker and applied for a mortgage. The agreement in principle was faxed to me within an hour. Margaret and I then instructed our solicitors, and asked them to fax a letter to the court explaining that they had been instructed to perform the conveyancing.

The next morning Margaret and I went to the court, and explained to the judge that Margaret had just found a buyer for her flat (me), and that we would like some time to complete the sale. The judge gave Margaret 28 days.

Over the next few weeks everything seemed to be going through ok until we tried to transfer the Lease for the flat. The flat was one of two that had been converted from a house 2 years earlier. The Freehold was owned by the developer who had converted the house into flats. However, he was not replying to our enquiries. I went round to the address on the leasehold, and the place was deserted. Margaret said he had never asked for service charge or Ground Rent, and it soon became apparent that, although he was the Landlord on the lease, he was not fulfilling any of his obligations, and was proving very difficult to find. My solicitor advised me to take out an Absent Landlord Indemnity Policy. This would insure me against any issues arising.

After taking out that policy, my mortgage lender was then happy to provide the funds, and we exchanged on completed within a couple of days.

Margaret is now living in her flat without fear of eviction, and has been a perfect tenant.
